Suggested Form of Agreement between Owner and Contractor for Construction Contracts: Stipulated Price constitutes the basic terms between the owner and the contractor. This contract sets forth in detail the contractor's basic duties and responsibilities and covers such areas as bonds and insurance; progress and final payments; substantial completion; status of the engineer during construction; owner's responsibilities; subsurface and hidden site conditions; changes in the work, contract price, or contract time; contractor warranties and guarantees; correction or rejection of defective work; work suspension or termination; and dispute resolution.

EJCDC includes the American Society of Civil Engineers, the American Council of Engineering Companies, the Professional Engineers in Private Practice Division of the National Society of Professional Engineers, the Associated General Contractors of America, and the participation of more than fifteen other professional engineering design, construction, owner, legal, and risk management organizations.
